Recording Consent

  1. An individual's recording is considered personal information by law. Therefore, you need his or her written consent (or that of a parent/guardian for people under 18 years of age) before you can publish the material for marketing, promotional or communications purposes.
  2. If you purchase a recording from an image bank, be certain to understand the rights associated with the purchase (length of license, reproduction rights, limitations, etc.). Keep a copy of the purchase agreement in your project folder.
  3. Any type of recording taken for marketing or publicity must always be accompanied by written consent. Use the Consent form to use photographic, video and audio recordings for this purpose.
  4. When video footage or photographs are taken during public events or activities (convocation and sports competitions, for example), a written consent must be obtained if reasonably possible.
  5. If you can't get a consent, you have to post a notice or a clear sign (on the event Web page, in promotional material and at the event entrance) to let participants know in advance that photographs or video images may be taken. For an event, print the Event Notice and post it at eye level at all entrances. Don't forget to include your email address in the place shown on the notice!
  6. If a person asks that his or her photograph or video image not be taken at an event or not be used after the event, you have to comply with the request. Also, remember that subjects who've given consent in the past may choose to withdraw it. They must submit the request in writing and, once again, you must comply with it and avoid using their recording after receiving the withdrawal of consent.
  7. Recordings must not be used or disclosed for purposes other than those specified in the Consent form to use photographic, video and audio recordings, unless the participant in question consents to it in writing.
